ADRESS BRASS LAI BOT A BRAY LOO EET, Key questions about no-fauit need answers Dear Editor: Julianne Lucier and Linda Huber raised a couple of questions about no-fault aute insurance in their Dec. 4 letter (Just say no to no-fault insur- ance plan for B.C In a no-fault auto insur- ance plan, “ no-fault” does not mean “no responsibility.” If Ms. Lucier and Hube broadsided by another vehi- cle, the driver of that vehicle weuld face higher premiums and aii of the appropriate legal penalties including fines and possibly jait. Drinking and criminally negligent drivers who are also injured in the crash they cause have their accident benefits reduced in some no-fault sys- tems. However, some people wonder if doing so might be unfair to the negligent mutorist’s family, who are every bit as innocent as others injured in the crash. This is a fundamental issue of values that will certainly be a part of the forthcoming debate on the future direc of auto insurance in B.C. Interestingly, the auto insurance we buy now is focused mainly on protecting us finan negligence age, an average B.C. moto could go out today and c: $1 million dainage and if they were unhurt, they would face nothing more than an in cin premiums. The fact that we aren't all out there wilfully running into cach other “because we're insured” suggests that fears expressed by Ms. ier and Huber would not 80, creation of a no-fult system would not leave TCRC as “judge and jurv” on claims. : fem used in Saskatchewan's no-fault pro- gram invelves lawyers acting on behalf of clients in their mediation Disputes not settled mediation could ultimately go to the Court of Queen's Benck. Clearly, British Columbians would want some medi or arbitration operating in pendently of ICBC or any other auto insurer, Can no-fault. auto insuc- ance cut costs and still be fair? Or can we improve our cur- rent system and satisfy the majority of people who feel e too high? Those are key questions that all of us will be able to answer for cur. once a public report on auto insurance options for B.C. is re d later this month. Lam appalled ar the type of methods North Vancouver District Coun. Crist is suggesting to shove the issue of throats of amalgamation down the North Vancouver City residents. What concerns me even more how: ever, is that his motion was actually con sidered and unanimously approved by the rest of district council. Tn case Mr. Crist, Mayor Bell and the rest of the councillors in the district have forgotten, we do five in a free country, The methods suggested to force this proposal on the city are exactly the same type of tactics that have caused 4 con: siderable amount of strife throughout the history of mankind. Wars have been fought over this type of thing. Have the district mayor and council- lors collectively forgotten the principles upon which this country is Gased and which se many Canadian lives have been Selected Ladies’ sacrificed ta protect? What Mr. Crist and Co, have forgotten im their totally sel ested way, is that we residents of North Vancouver City also elected a council to protect and guard our interests. As a tree Canadian citizen, I must take a stand and say that f find ir very fticult to believe thar Mr, Crist is seri- ous about what he has proposed. Of even greater concern to me though, is the fact that his proposed method of stripping us of our funda- mental freedom of choice, appears to have been unanimously supported by the rest of district council. hough he did very well in’ the polls, nobody has given, Mr. Crist, or the district council for thar matter, the mandate to change the law in order to persecute a group of their neighbors for not agreeing with the pect of the motives thind S propo al. Is the district in such bad financial shape, or has it over-extended itself to such a point, that it can see no way out other than to attempt the forceful pure of the assets of its closest neigh- bor? Whatever the reason or the ci cumstances leading to it, the way this proposal has been pre ented is funda- mentally wrong and should not be pr moted any further in its present for { trust that Mayor Loucks and the other elected representatives on our city council will continue to prevail in this issue and unanimously tell che district to back off. If there are legitimate concerns that should be addressed, of if there are underlying financial co ns which the city can help the district with, itis up to Loth councils to talk together sanely and rationally about them and come to solutions which will benefit both com- munities.
