Drivers guilty of drinking

RECENT CONVICTIONS in
North Shore courts have resulted
in fines and penalties, including a
one-year driving suspension, for
drinking and driving related of-
fences:

NORTH VANCOUVER: Gregory
Larson, 30, 2081 Anita Court,

North Vancouver (impaired, $300
fine).

WEST VANCOUVER: Donald
Henney, 60, 4567 ‘Mountain
Highway, North Vancouver (im-
paired, $400 fine); Michael Albert
Stone, 27, 1108-235 Keith Road,
West Vancouver (impaired, four
months jail).

Question: In the recent bad
weather, my car, which I had
parked in the road autside my
house, was in an accident, A big
truck came around the corner,
skidded on the ice, and slammed
into it.

1 bought the car in 1980. That
was the year ] retired and, because
I thought it would probabiy be the
last car 1 would own, FT looked
after it exceedingly well, hoping it
would last me a long time.

Now, all of a sudden, my car is
squashed beyond recognition and
ICBC says it is not worth repair-
ing. Te add insult to injury, they
want to offer me ‘book value.” I
feel the offered compensation isn't
nearly enough to replace a vehicle
that t had lavished such care, at-
tention and money on. What
should [ do?

Answer: It is ICBC’s aim to put
you back into the same position
you were in immediatcly prior to
the accident. They will compen-
sate you by giving you enough
money to replace your car with
exactly the same model and year

*‘Autotrak.”” This system collects
and records information on the
recent sale prices of automobiles
in B.C. in a computer database.
The computer will compare details
of the car you are trying to
replace with similar cars that have
been sold recently, and will come
up with a replacement cost.

When they assess your car, they
will take into consideration things
like the condition of the tires,
whether there is rust) on the
bodywork and whether you have
extras on your vehicle such as a
sunroof or electric windows,

They would also probably be
interested in seeing your service
records for the vehicle, to see that
it is in top condition. Remember,
however, that) most mechanical
repairs are considered part of reg-
ular maintenance and their cost
will not increase the value of the
vehicle beyond the price of a simi-
lar vehicle in similar condition.

Your adjuster will be willing to
negotiate with you, within the
range indicated by the Autotrak
valuation,

If you are still unhappy with the
value set by ICBC, you can
choose to submit your claim to
independent arbitration. You ap-
point an independent appraiser
and he or she will meet with the
appraiser from ICBC and negoti-
ate fo try to reach agreement on a

valuation,

Each party is responsible for the
cost of his own appraiser and the
appraiser’s decision, presented in
wruing, is binding. If the ap-
praisers are unable to agree, they
will choose an umpire who will
review the issues and make a deci-
sion. The cost of the umpire is
shared equally by the two parties.
