Ternes guilty of negligence NORTH VANCOUVER'’S Robert Dale Ternes was found guilty Tuesday in Vancouver county court of criminal negligence causing ‘death and criminal negligence causing bodily harm in connection with the Feb. 11 death of a 14-year-eld North Vancouver boy. But the 33-year-old was found not guilty of impaired driving, although Judge John Cowan found that alcohol did play a role in the tragedy. The decision followed a four-day trial into the four drinking driving-related charges faced by Ternes in connection with the Feb. 11 accident that resulted in the death of Stephen Oakley and serious injuries to Craig Potter, 15. In addition to the criminal negligence charges, Ternes also faced charges of impaired driving causing death and impaired driving causing bodily harm. The charges were Inid against hii after a Toyota Tercel jumped a sidewalk in the 1000-block of Montroyal Bouleverd and ploughed into a group of Handsworth Secondary School students. Ternes will be sentenced next month. During the ‘trial, Ternes, an employee at North Vancouver’s 13th Street and. Lonsdale Avenue Safeway, told:the court that he had consumed five glasses of beer at two Vancotiver hotels after work- ing a midnight to 8 a.m. shift at the Safeway store, but said he did ‘- not feel he was out of control. . -. An RCMP breath analysis of the accused taken after Ternes had . been zeleased from hospital resulted in readings of .210 and -200 mgs. But defence Jawyer Richard Peek argued that blood-alcohol readings - attributed to Ternes ran contrary to. the evidence of various defence witnesses.
