He also wants Bastion to take responsibility for broken water-mains and broken promises. Hartley visited the super- intendent, the general man- ager and the vice-president of Bastion Construction, in an attempt to get the com- pany to pay for his broken water-main (which the com- pany now has done), his cracked driveway, his neighbor’s cracked retainer wall and another neighbor’s broken water-main — the results of pylondriving at the commercial site. After phone calls and visits from Hartley, Bastion paid Hartley the $81.07 he paid to North Shore Plumb- ing and Heating to have his water-main repaired. “‘T have never given up with Bastion,’’ Hartley said. ‘‘f was paid the $81. And now the adjuster is supposed to be coming to settle the neighbors’ claims and my cracked driveway." A water-main was also broken on 17th Street, which Hartley said District workers repaired, as it comes under their jurisdiction. But he was not sure if Bastion construc- tion reimbursed the District or if it was repaired at the taxpayers’ expense. Hartley has also voiced concerns to Bastion as to the appearance of roofs planned for the commercial site, because he said, ‘‘l have to look at then: for the next 10 to 20 years.” Hartley said Bastion su- perintendent Dick Stolar promised him the roofs would be very attractive, which Hartley said architect Neil Palman confirmed. “The architect said the roofs would aesthetically comply with the Marine Drive corrider plan,’’ Hartley said, ‘‘and the roof of Boston Pizza would be metal and modern, like other Boston Pizza roofs. But what it is is a flat, tarred and gravelled roof.”’ : Hartley said he called Palman about the tar roof, which Hartley overlooks from his home. But Palman said he could only work within the parameters of Bastion Construction. Hartley contacted general manager George Melville from Boston Pizza, who Hartley said told him, ‘The roof is a District problem, we've got a permit. What do you want me to do? Paint it pink?’ Boston Pizza president Jim Treleving gave Hartley a more welcome treatment, apologizing about the roof, Hartley said, and saying his company didn’t want resi- dents unhappy. Although he will only be leasing the building, Trelev- ing made the concession that he would try to get white gravel put on the roof, to make it more attractive. Hartley said he is a con- cerned citizen standing up for what he believes are his rights as a resident.
