Without « will your property will be distributed according to law, and in a way that you might not wish. Without a will, if no relatives can be found, Her Majesty (in the person of the government) will in- herit your estate. ‘With no will, the law directs that your estate will go in part to your spouse and in part to your children. You may have assumed that it would all go to _ your. spouse. And, if your children are under legal age, your spouse may have great difficulty dealing with your assets without court approval that such dealings are in the best inter- ests of your children. If your spouse has predeceased you and you die without a will, the law will direct that all your children will share equaily despite the fact that one of them may have looked after you in your old age or may already have received consid- erable financial assistance or may simply be unworthy. You should not rely on your children doing the “‘right thing’ after your death to rectify these kinds’ of circumstances. They might have the best of intentions. - But suppose that they or their fam- ilies found themselves in poor health or desperate financial cir- cumstances. They might sirnply be unable to afford to give away their share 30 as to distribute your estate as they krow you might have wish- ed.
