‘SORRY to disturb your looming holiday reveries, but it’s the Collins thing again. Not going to go away guietly, Pm afraid. And a good thing too. As most News readers will be aware, Collins, aka the ex-columnist anti-Chiist, continues to wage war with the Human Rights - Commission and the ‘see: tions of the province’s ‘Human Rights Code that limit basic free expression for kim and the rest of the province’s residents. Thus far he is running into stiff resistance. ‘Government battalions have been deployed to battle the ‘demon. This even though human rights tribunals across the land have been found to be politically partisan and hope- lessly biased. Through lawyer Doug Christie, Collins argued that the tribunal’s decision and the section of the Human Rights Code upon which it was based violate Charter rights of free expression. They. also argued that the Human Rights Code estab- lished a tribunal that is nei- ther independent nor impar- tial. . ; Hey, I thought that was a On, Lube & Fi foregone conclusion. Not so. The judge found that the tribunal's order penalizing the News and its ex-colum- nist is not final because the constitutionality of the Human Rights Code sec- tions at issue and the consti- tutionality of the tribunal itself had not been deter- mined by the tribunal in the previous hearing. In her decision, Judge Quijano has ruled that the tribunal should determine both of the outstanding constitutional issues. Js, other words, a biased at. of the government is going to ponder whether it and legistation drafted by that same government is valid.
