4 — Wednesday, April 24, 1996 - North Shore News Plea saves dollars From page 1 charges under the federal Competition Act dating back to Novenber and December 1994, Three other charges against the busi- ness and the same charges against the Kalenuik brothers were dropped. The dropped charges stemmed from incidents in Ottawa in November 1994. Burnaby the next month and Kamloops in January 1995. Investors Choice lawyer Peter Eccles said the salesmen at the 1994 mectings didn’t know how much a typical person made because the business was new. “The reality of most sales’ schemes is some (people) make it, most don’t.” said Eccles. Investors Choice, also known as Fortune in Motion, bought up discount travel vouchers for long-weekend trips. ‘The trips were purchased from travel operators who had unsold seats on those trips. The mini vacations included four-day cruises in the Bahamas or weekends in Orlando, Florida. Under the scheme, one person would buy eight of the Fortune In Motion trav- el vouchers for $500. Each voucher would be sold for $500 to someone lower down in the multi-tiered market- ing pyramid, according to Eccles. 66 What we have here is carelessness, sufficient to breach the act. 99 — Lawyer Peter Eccles He said that “undoubtedly” there would be instances when one person would end up buying only one voucher and not make money on the voucher's resale. The amount of money a typical per- son made was not disclosed in court. Eccles said the Competition Act was designed to ensure that sales people did not “blindly make representations." “What we have here is carelessness, sufficient to breach the act.” said Eccles. Straith said Canada allows pyramid sales plans to operate with “stringent” restrictions. Judge Bill Rodgers levied the $70,000 fine, agreed to by the lawyers . before court began. A two-week preliminary hearing into the case had been set to start on Monday. The accused decided to plead guilty last weck, saving themselves at least $50,000 in lawyers’ fees for the trial and preliminary hearing. The Better Business Bureau (BBB) in Vancouver says that Investors Choice Product Brokerage Ltd is also known as Fortune in Motion Inc, World of Wealth and Fortune Builders. The business is not a member of the BBB. David Kalenuik, the BBB states, has been investigated for illegal pyramids involving Fortune in Motion in lowa and Wisconsin.
