We did not win everything, but after five weeks of trial over seven months we thought we had suc- ceeded in recovering the majority of our economic loss, Morcover, we thought our 34- month ordeal was almost over. We could forget about the District's Jack of sensitivity, We could ignore the District's refusal to negotiate in good faith a satisfactory settlement for all par- ties at a fraction of the cost. We could put behind us their bumbling efforts of using a defence of failure to mitigate our loss (subsequently withdrawn). But no. It is not over, We have not won, The District has given notice to appeal the judgment. Our friends comfort us but they are truly amazed that this saga is being extended at District tax- payers’ expense. Mr. Palmer, the municipal manager, has the temerity to dismiss Brent Mudry’s recent arti- cle in the News because of alleged misleading statements. Talk about the pot calling the kettle black! It was the District's own counsel defending the case, It was the District's own of- ficials called as defence witnesses. We were not sting the insurers, we were suing the District, In response to council's motion requesting an independent — in- vestigation of this matter, Palmer was obvicusly slow in obtaining a copy of the judgment. The District had three high. priced lawyers present for most of the five weeks of: trial, plus a fourth at one stage Couldn't one of its own lawyers have kept the District informed? Neither the District nor its in- surers maintained a@ presence at the trialitself. Palmer comments that “the judge arrived at decisions based on information he did or did not have from 29 to 35 years ago.” The judge’s . decisions were based on the evidence of two eye-witnesses from 1961 whose testimonies were not rebutted in cross-examination, In addition, the judge consid- ered the evidence of the Ripley Demand an end to pensions Dear Editor: .., | would like to think we are on -a roll here in Canada.
