I lent him some money over a year ago when he had his roof zeplaced and, although he paid me regular installments for the first six inonths, since then I have had nothing but promises. ‘The amount ke still owes me is $3,750. I am hoping that the threat of a court action will make him see that J mean business. How do I get started? Will I need a lawyer? Answer: You do not need a lawyer in Smal! Claim Court; you can conduct your case yourself. in order for your claim to fall under the jurisdiction of the Small Claim Court you wil! have to be prepared to reduce the amount you are claiming to $3,000 — the maximum that a Small Claim Court can deal with. This is called ‘‘abandoning the excess’’ and means giving up your claim to the $750. You are not allowed to split the claim into two claims for smailer amounts. The clerk at the Sinall Claims registry at the Court House will give you a pamphlet which will help you to fill out the summons. You will then file it at the regis- try at the cost of $25. Now the summons must be served on the defen- dant. You cannot do this yourself. You can get a friend who is not involved in the case to serve the Papers, you can employ a civil process server or you can send the summons by double registered mail. ‘This last way is probably the most common and easiest way of serving a summons. Just be sure to keep the pink card which the post office returns to you as proof of service. The defendant has 10 full days after the summons has been served to file a Notice of intention to Dispute. If he does this the registry will notify you, by certified mail, of the date of the trial. Currently there is = wait of approximately four months for a trial date. If the defendant does not file an Intention to Dispute you may file for a judgment. If you do not hear anything within two weeks of the summons being served, check with the registry to see if you can file. Judgment is not automatic. Let’s hope that you are right in thinking that receiving a summons will be enough to get your neighbor to repay his debt. If it isn’t, and you end up in court, be prepared to show proof that you lent the money and of the payments he did make to you.
