Petro-Canada petition claimed bylaw unfair From paae 1 opment plans for gas stations. It prevents full services stations from being converted to self-serve only. Stated Williamson in a March [7 finding, “A reasonable per- son could: easily find justification for this zoning. Nor is it unreasonable to require full-service pumps as a benefit to these citizens who are elderly. or disabled, or who do not wish to light from their automobile in cold weather.” The judge disagreed with Petro-Canada’s lawyer Richard DeFilippi, who argued the bylaw was “parently unreasonable” and was beyond the authority of the municipal government. Petro-Canada had also argued that the bylaw was discrimi- natory in that it was designed to benetit a minority of people at the expense of the gas station owners. The judye said there was “no improper mothe” if there was discrimination in the bylaw. “It is apparent trom the material that the members of coun- cil identified a need in the community for gas stations with ser- vices bays,” stated Williamson. “Whether they were correct in that assessment of community needs is nota matter which con- cerns the court.” District lawyer Grant: Anderson successfully argued that the municipality acted properly by detailing the characteristics of permitted use in the amended zoning. Meanwhile Petro-Canada station licensee Tom Nevison said each station site should be looked at as a business decision. “If ir is not economically feasible then it cannor be a viable business,” said Nevison. Nevison runs the full-service station at Mountain Highway and Main Street that also sells natural gas and propane. He also tuns the self-serve station at Capilano Road and Marine Drive. Nevison said if a full-serve attendant sits tor the last three hours of his shift, there’s no way to recoup the wages. He said the full-serve loss detracts from the rest of the station’s business. Nevison noted that his full serve customers have dropped about 6% since last year. Nevison said the same business viability issues apply to service bays. “[ can’t see me as an independent business person, or the oil companies, would want to be there to lose money,” said Nevison. District Coun. Ernie Crist. said on ‘Tuesday that the issue was still open to a review, but the principle was set in the bylaw. “We have an obligation to the public at large to uphold the interests of the public,” said Crist. He said it was in the public's interest to have full service pumps and service bays at gas stations. “The industry is not interested in that. It is only interested in making super profits.” said Crist. Crist believes the “small guy” who looks after his customers with personal service can stay in business. North Vancouver District has nine fill service gas stations. Wednesday, March 22, 2000 - North Shore News - 13 WHAT'S NEW ? Spring 2000 opens with a fresh new look. New colours New styling and .
