The Rousseaus are scheduled to make their first court appearance on the charges in West Vancouver provincial court on April 23. The charges follow a March 9 incident in which the two were alleged to have attempicd to repossess portions of the pizza partor’s refrigeration unit follow- ing a dispute over payment for tepairs alleged to have been per- formed on the unit by C.R. Ice Machines Inc. The owner of the shop main- tained in the March 18 News story chronicling the confrontation that the Rousseaus pulled up to his Pizza 222 restaurant in a Rolls Royce and attempted to remove the equipment after a $1,453 che- que offered as payment for the repairs was refused. But Hector Rousseau maintains that the chequs was rejected by the Pizza owner’s bank because of in- sufficient funds, and that his son’s company had the right, under the terms of his company’s repair agreement, to enter the restaurant at any time to retrieve th: refriger- ation parts installed. A rider in the Rousseau com- pany repair invoices states in small print that, ‘Title to and property in the equipment and/or parts purchased by the customer remains in the seller until payment in full of the purchase price. If the price remains unpaid after 10 days or the customer’s cheque is dishonored, the customer authorizes the seller to enter the customer’s premises without netice and remove the equipment and/or parts and releases the seller from any liability for damages of any kind and however caused, arising out of the said entry and removal.’’ Total damage to the pizza parler has been estimated at $2,000.
