Walsoff said his client was
extremely intoxicated when
he took the card out of his
friend’s purse at her home on
Sept. 21, 1996.

Since Bales was charged
with the crime, he has not
used cocaine and had started
a substance abuse program
called Alternatives, said the
defence lawyer.

Walsoff said Bales did not
have a criminal record and did
not have any outstanding
charges against him.

The defence lawyer asked
the judge for a discharge, a
sentence that does not carry a
criminal record.

Judge Jerome Paradis said
his decision to give someone
a sentence that carries a crim-
inal record is based on
whether he feels community
members need to be warn

“This is a close call ...
People involved in drugs find
it difficult to keep with their
intentions,” said the judge.

The judge acknowledged
that Bales had made efforts to
address his substance abuse
problem.

Paradis gave Bales a condi-
tional discharge and _ placed
him on probation for nine
months. Bales was also
required to perform 35 hours
of community work service
and pay $380 in restitution to
the Royal Bank.
