Mill’s pollution charges stand WESTERN PULP Partnership tried unsuccessfully last Friday in B.C. Supreme Court te have 12 pollution charges laid against its Woodfibre pulp mili in Howe Sound dropped. Mill lawyer Edward Chiasson argued before Justice Patrick Dohm that the charges, laid in August 1989, should be tossed out because the company had a deal with the B.C. environment ministry that no charges would be laid if the mill did not violate any more environmental laws and continued work on a $70-million clean-up program. In denying Woodfibre’s request, the judge culed that he found no evidence to support the mill's argument that there was an agreement between Woodfibre and the environment ministry. Pro-life teacher case back to IRC THE CASE involving two North Vancouver teachers who opted out of the B.C. Teachers’ Federation (BCTF) and the North Van- couver Teachers’ Association (NVTA) after they objected to the unions’ pro-choice abortion policy, went back to the Industrial Relations Council (IRC) this weck. In 1988 the IRC ruled that North Vancouver teachers Justin and Nancy Wasilifsky could not leave the BCTF and NVTA on religious grounds. But that decision was overturned in 1989 when an IRC appeal panel ruled that the couple could opt out of their labor unions because of their profound religious beliefs aad oppesition to the unions’ policy of reproductive freedom. But a second IRC reconsideration hearing on the issue began this week. The seven-chairman hearing panel includes IRC commis- sioner Ed Peck. Allan Slack, a lawyer for the BCTF and NVTA, argued at the hearing that Section 11 of the Industrial Relations Act allows for exemptions from union membership only on the grounds that the applicants object to the unions as a whole and not on the basis of single union policies. According to Black, the Wasilifskys participated in several uaion activities which meant they had supported the union. The IRC reconsideration hearing continues.
