A6 - Sunday, September 9, 1984 - North Shore News Gl editorial page 7 The thin line he case of the two Burnaby RCMP of- ficers found guilty of unlawful ‘‘hard- line’’ interrogation tactics against a suspect in the brutal 1982 slaying of Sharon Bollivar gives law-abiding citizens food for thought in this increasingly violent age. Their tactics, though threatening, did not involve physical harm to the suspect — who, together with two others, was later convicted and sentenced to life imprisonment for kid- napping and murder of the supermarket manager's wife. The wise judge in the officers’ trial has now given them an absolute discharge. He noted that the intense nature of the investigation, allowing the officers little sleep, and the emo- tional nature of the case had evidently led to ‘‘a loss of judgement’’. One officer, in addi- _ tion, had been shot at during the arrest of another of the murderers. The law, including the rights of suspects not yet tried, must, of course, be upheld. Moreover, police officers CAN be mistaken and must never be permitted to usurp the role of the courts. That, as Judge J.K. Husband observed, is a cornerstone of our democratic way of life. Nevertheless, in this particular instance public sympathy is likely on the side of the of- ficers. Knowing a suspect to be guilty beyond reasonable doubt (as the police often do) is not the same as producing the hard evidence needed to convince a judge and jury. But if such evidence is not obtained, how many murderers, rapists and muggers may go free to kill or injure other innocent victims? Where is the line to be drawn, and by whom, asked the judge. It’s a thin line — and a good question for all of us. Rights? Wrong! ntrenchment of property rights in the Canadian Constitution, called for last week by North Van District council, would be worth no more than any of the other “‘rights’’ in that flawed document — all of which are made subject in Article 1 to ‘‘such reasonable limits prescribed by law...’’ And who is solely entitled to justify and pass a law that removes your rights (including your right to vote if you look like making a fuss)? The government of the day, that’s who!
