# — Sunday, April 25, 1999 - North Shore News Reporter ‘disappointed’ From pagel school rumor mill, or staking out funcral homes, . D°Angelo wrote in her submission. “| would prefer to obtain the deceased person’s name from the police.” Flaherty received written submissions from both the News and West Vancouver Police, as well as the Victims’ Services Division of the Ministry of Attorney-General and a member of the victim’s family. The latter, Flaherty Wrote, was “very touching” and “set out clear and com- pelling reasons for refusing to agree to disclosure of the vic- tim’s name.” The letter from the victim’s family was received in camera and not quoted in Flaherty’s report. A verbal request made by the News on Friday for a copy of the letter was denied by Helga Driedger, registrar in the Victoria-based commis- sioner’s office. After reviewing the deci- sion, D’Angelo said: “I"m dis- appointed and support an appeal of the finding, bur that’s nor my decision to News managing cditor Timothy Renshaw is consider- ing whether to apply for a judicial review of the matter. He said Flaherty’s decision sets a disturbing precedent. “Mr. Flaherty has signift- cantly expanded privacy nights by ruling that the next of kin have a privacy interest in the identity of a deceased person,” Renshaw said. “As we have argued, as far as the News can determine, the next of kin are acting on their own be half, not on behalf of the deceased.” The decision will influence how other police departments release information to the sedia and = the — public, Renshaw speculated. “Will names be shielded from public scrutiny in other cases?” Renshaw said.
