NORTH VANCOUVER District Ald. Joan Gadsby’s claim for $1,597 against North Vancouver lawyer and fellow Ald. Bill Rodgers was dismissed April 23 in North Vancouver small claims court, By ELIZABETH COLLINGS News Reporter In her statement of claim, Gadsby accused Rodgers of negligence when he was negotiating a settlement for her in a wrongful dismissal action against her former employer. Gadsby alleged that Rodgers, a partner in Lakes, Straith and Rodgers, failed to advise her within sufficient time of the con- fidentiality terms of the settlement, which he received July 14, 1989. She did not receive notification of the confidentiality clause until July 17 and had already discussed the settlement during that three- day interlude with an employee of Gadsby’s former employer. The result was that the original out of court settlement was settled on terms less favorable to Gadsby. But in his reasons for judge- ment, Judge C. Bakony found that it was unreasonable to expect Rodgers to verbally caution the . plaintiff not to contact her former employer or discuss the agreement. “*‘He could not foresee the lunch meeting or reasonably expect the plaintiff to call the former employer before receiving the agreement couriered to her the same day, particularly given her knowledge and experience,’ the indgerment stated.
