It is difficult to do business at City Hall, and so on: Perhaps the municipal workers should be classified as “essential service”? Now, after one short immigration inquiry, which only discussed whether she had a visa, Stelia must leave her Canadian born husband, or David must leave his job and follow his wife back to Columbia.. Even though a sponsorship hearing is still scheduled for February 17, Immigration would not permit Stella to stay until that time as she would require a_ special ministerial permit to do so and local Immigration of- ficials have refused to issue one. David Hoffman was yesterday trying a last-ditch attempt to have the departure put off until tomorrow (Thursday) since. Stella was concerned about having to spend 24 hours in San Francisco on her own when she does not even speak any English. . Her husband says of the situation that has led to their dilemma: “We were told in Columbia that because she was: .divorced in Santa Domingo, a_ divorce recognized by Canadian civil law but not by the Catholic government in Columbia, she would be unable to obtain a visa to enter Canada as my wife,” Hoffman said. “I want to live with my wife in my country. Somehow I thought this was Canada and they would understand. But they won't even let.me explain why we came to Canada without a visa,” he adds. Columbia does not grant divorces for marriages made in the Catholic church, although it will permit divorces for civil marriages. Canadian immigration law stipulates that a visa must be obtained from the country of origin and that the laws of -that country must be ob- served. To complicate matters, the Hoffmans were also told that because Stella is his wife, as recognized by Canadian civi) law, she would not be able to enter on a tourist visa. Because the Hoffmans could not obtain a visa in Columbia, they flew to Canada in hopes of being able to explain their situation to officials here. NOT INTERESTED “We told them (im- migration) as soon as we entered Canada, but they weren't interested in the circumstances, only whether she had a visa or not,” he said. Hoffman's lawyer, David Finlay, says they are caught in a “Catch 22” situation. “There appears to be no simple solution ... necessary for immigration to put a time limit on this sort of thing. David's wife should be allowed to remain with him,” Finlay said. “The immigration department is not showing any understanding or compassion to their cir- cumstances.” David Hoffman says: “The only thing they keep telling me is that I can stay in Canada.
