The trial of Roy Costa, aged 30, took place last Wednesday in North Vancouver Provincial Court before Judge C.J. Woodhffe. Costa was charged with assault causing bodily harm on June 13 after he allegedly punched and kicked Walter Kasacoff in the face during a fight on a construction site al 14th Street and Mahon Avenue. Kasacoff told the court, Wednesday, that he was not working at the time and that we went to picket the site with other unionized workers “because it was a non-union job and the contractor was not keeping up to his agreement.” While he was “rummaging through the junk” in a large garbage container at the site, Kassacoff testified that Costa, who was working on the site, told him to get out of the bin. After a brief = scuffle, Kasacoff said they ended up on the ground outside the bin with Costa on top of him punching in the head. Two other picketers at the site, Fred Zmaeff and Gerald Rupprecht testified that they witnessed the fracas. Rupprecht who eventually seperated Costa and Kasacoff said that at one point: “Walt (Kasacoff) was on all fours. His glasses were broken and his eyes were swollen. He was trying to grab ata rock on the ground. Costa had one hand on the scruff of Walter's neck and punched him in the face.” Defense counsel TJ. He said Kasacoff grabbed him and as he (Costa) pulled away he fell backwards on his head and_ Kasacoff landed on top of him.
