ae a Win her ntighbors” privat north shore AIL B ree bylaw meddles Sin our private affairs : Bear Editor: I cannot help bur respond to the recent Mafront-page story of the lady complaining fae about her neighbors’ tree-cutting. While the preservation of the environment is obviously a worthy and Necessary goal, disturbing, Even more disturbing is the willingness of Mlocal government to further tighten these § bylaws withour meaningful public input. There is more at stake in these bylaws than trees. The bylaws severely restrict what should MM be one of our fundamental rights: the right to do as we wish on our own property so long as fag we do not injure our neighbor. I say “should be” because it seems clear that little in our laws or governance protects an individual’s rights at all, while the infringe- ment of those rights by government is con- @ stant and insidious. The passage of any law should involve a g balancing act questioning the public good or Be necessity, on the one hand, and rhe rights of : individuals on the other. MAILBOX POLICY The question “what moral right do we have to tell people what to do” seems to be too rarely examined in practice. Obviously the preservation of the environ- ment is an important public good, and the tion Of whether tree-cutting on private land in fact “injures vour neighbor” must be considered, But while preserving trees for the sake of preservation alone is a worthy goal, the envi- ronment of the individual is also important, in terms of access to sunlight, a usable yard, ete., especially on the North Shore where the abun- dance of trees is sometimes overwhelming (and certainly t threatened in any serious s¢ bylaws were aimed at avoiding the clear-cutting of lots by developers, | would be in favor, but surely then the bylaws could be narrowed to. suit this objective. And if the point of the bvlaws is far more general, as it appears to be, then | think they go much too far.
