A NORTH Vancouver man
who pleaded guilty to sexually
assaulting a 13-year-old girl
three months after being
denied refugee status in
Canada was given a suspended
sentence on Friday.

‘Afshin Kamalvand, .27, was
‘charged with one count of sexually
assaulting the girl at the Tanoor
restaurant, 1445 Lonsdale Ave., on
Aug. 11, 1993.

Kamalvand’s . lawyer, Phil
Rankin, had argued strenuously
before Vancouver. provincial court
Judge, Herbert Weitzel that his
client should be given a conditional
discharge for. the: offence which
does'not carry a criminal record,

added that there were 30 days in
which to appeal the judge's finding.

Crown lawyer Vanda Spence
was also unavailable for comment,

North Vancouver MP Ted White
said that Kamalvand was appealing
the refugee status denial by the
Immigration and Refugee Board.
White said Kamalvand currently
has a valid work permit.

At the time of the sexual assault,
Kamalvand worked as a cook at the
restaurant. The girl's mother
worked as a waitress there. The
teen was helping her mother clean
up after closing time when she was
sexually assaulted as she was pol-
ishing silverware behind a bar area.

Her mother was vacuuming
nearby.

Police seized the girl’s torn
panties and a medical exam sup-
ported her allegations.

An court Rankin called the inci-
dent a ‘preposterous seduction.”

Meanwhile ‘Vhite said about
refugee hearings, ‘““What upsets me
is that we fund the appeals that go
on for years and years and years.

-“TIt seems to me we should guar-
antee a fair first hearing. If some-
‘one wants to appeal that and drag
this on for years, they are going to
have to raise the money them-
selves.” :

was described as being in his 50s,- Caucasian, 17m (5’6”)

was described as being in his 30s, Caucasian, 1.7'm (5’8”),
