West) Vancouver resident Allen, Richardson, 50, failed in his didi to have his: four-vear prison sentence declared illegal and) void. Richardson’s New York State lawyer argued the sentence was harsh, excessive and so grossly disproportionate to the offence thar it constitut- ed cruel, unusual punishment. Richardson, whose real name is Christopher Samuel Perlstein, was sentenced in 197} to four years in jail for sclling $20 worth of LSD to an undercover police officer. Richardson was a student at Rochester Technology (RIT) at the time. His sentence was upheld on appeal. Richardson spent a short time at Attica prison before being sent to a mini- mum security work camp called Camp Georgetown, according toa Nov. 9 decision and order by Monroe County Court Judge John Connell. Notorious Attica prison had an uprising that left 43 people dead. Richardson claimed a work camp guard said he'd be returned to Artica where “they Institute of knew how to deal with peopic like” him. Richardsen decided to escape and came to Canada. “The Correetions’ failure to. secure an arrest warrant: or sealed indictmeni tor escape charges is also evidence of their lack of single-minded vindictiveness as alleged by the defendanz,” stat- ed the judge. The judge said that Richardson portrayed him- self as a suburban college stu- dent iolved in anti-Vietnam war campus protests and reere- ational drug use in dormitories, Richardson believed he was sent to Attica, in part, because the RIT dean thought Richardson had a “vocal and foulmouthed role” — during demonstrations — after Kent State. Judge Connell said Richardson’s — pre-sentencing repor? indicated that “while ar RIT he bought and sold drugs somewhat indiscriminately both from fellow students and outside sources.” When sen- tenced Richardson had no remorse, stated the judge. As sentence such as Richardson's four-year term usually involved 12 to 18 months in jail followed by parole. The time in Attica “was consistent” with determining what type of jail was apprepri- ate for an inmate, said the judge. Connell acknowledged that Richardson was now a Department of Sunday, November 14. 1999 — Nerth Shere Nows — 11 West Van man must face jail past responsibly, respected commii- nity member.
