Mother's television set stolen twice by son _By Anna Marie D'Angelo News Reporter dangelo@usnews.com JAMES Marshall Rae broke into his _ mother’s West Vancouver home two times within one month last sum- mer. He stole the same television set nice. On Aug. 27, Rac, 36, was given a 12- month conditional jail sentence for the break- ins. North Vancouver provincial court: Judge Jerome Paradis said he was satistied that the cocaine user could serve his sentence in the community without causing others problems. But the judge noted that Rae’s pre-sente ing report “was less than promising. Rae had not shown up for a scheduled interview for the pre-sentencing report. Paradis noted thar the North Vancouver man failed to show for appointments with a bail supervisor “50%” of the time. Paradis said that if Rae didn’t abide by his conditional jail conditions, his community sen- tence could turn into real jail time. A year ago, Rac forced open a ground fevel window at his mother’s Folkestone Way home. . He stole a television from a bedroom and a VCR from the den. A fake Rolex watch was “among the other items taken, said Crown lawyer Mike Brundrett during sentencing pro- ceedings. West Vancouver Police obtained finger- prints which linked Rae to the crime. Less than a month later, on Sept. 20, 1996, West Vancouver Police were called to an over- turned van on the Trans-Canada Highway at 2:30 a.m. Police were unable to determine who was driving the van, Rae or his wife, said the Crown lawyer. At the police station, Rae blew 0.26 and 0.17 for blood Acohol content, pice the legal limit. “He also had multiple marks on his arms,” Brundrett. “Police confirmed he uses cocaine.” Inside the overturned van, police found a 26-inch television set that was later determined to have been stolen from Rae’s mother’s home that night during a break-in. Brundrett said the television was probably going to be sold for money to buy drugs. The Crown lawyer did not ask for a jail sen- tence. He suggested Rae be placed on proba- tion and receive drug treatment and drug counselling. Rae’s lawyer Robert Reid said his client still had a drug problem, but was under treatment by a doctor. “His mother basically supports him quite a bit,” said Reid. The defence lawyer indicated that Rae’s mother paid the mortgage on Rae’s Highland Boulevard home. _ “She was away when he was, I guess, dcs- perate,” said Reid, in explaining the motive for the break-ins. Rae, with short strawberry blond hair and wearing a grey-blue suit jacket and jeans, said nothing to the judge during the court pro- ceedings. A victim impact statement from Rae’s step- father was given to the judge.
