By Brent Mudry Contributing Writer A decision released Monday ends a four- year legal battle invelving a comptex leasing dispute. B.C. Supreme Court Justice Frank Maczko noted that Peter Malek, the head of Marksearch Properties Ltd., misted the club, the District of North Vancouver and the court on several occasions. The judge ruled that fandlords Marksearch and Co- Operators General Insurance Company were jointly in breach of contract. In a 55-page decision, Justice Maczko ruled the landlords repeatedly acted in bad faith and took advantage of the club’s pre- carious financial situation to dictate unrea- sonable terms. The judge found that Malek used the North Shore Winter Club to push several revised plans for the property through council, then reneged on his clear commitments to the club, said club manag- er Michael Whalen. The controversy traces back to 1989, when Marksearch bought a 50% interest in the club‘s property from Co-Operators. He was attacked on Sunday and found blecding in a lane in the 760-block of West 20th Street in North Vancouver. The victim, a 44-year-old Vancouver man, was stabbed in the back, hand, neck and head, according to a North Vancouver RCMP spokesman. His tung was punctured in the attack. But sometimes people are charming and so nice to you and then all of a sudden they point a gun at you.” He said cab drivers are aware of the potential risk of the job and try to work as safely as pos- sible. North Vancouver RCMP Const.
