suspect probably has to pay
for any damages to the
police car when the smoke
clears from a_ high-speed
pursuit.

The Ontano government
has won a suit forcing a man
to pay for damages to a
police car, even though
officers deliberately
slammed their cruiser into
the man’s car to stop him
during a high-speed chasc.

Crown civil faw office
director Julian Polika said
the case was the second ume
the courts have favored the
police in accidents involving
chases.

A Brant

County judge

ordered Paul Stery of
Toronto to pay $850 for
damages to a police car he
led on a 120-kph chase
through the streets of
Brentford. Police stopped
Stery by crashing into his
car.

“The deliberate act is
excused by the fact it was
done out of the duty laid on
him by the Police Act - to
apprehend a_= criminal,”
Deputy Judge Marc
Lefebvre said.

Stery also stands to lose
his heense for ignoring a
police request to stop.

In the first case. the
Ontano Court of Appeal
ruled in 1978 that a woman
was hable for more than
$26,000 damages to a police
car which was demolished
