QORETE Teas oie nt ae SD The Greenpeace Foun- dation has been informed | that the Supreme Court of Canada has granted leave to appeal in the case resulting from. charges of unlawfully sealing on a Sunday against three Newfoundland sealing captains and a former Newfoundland cabinet minister. The charges were laid by Greenpeace President Dr. Patrick Moore following the -1978 seal hunt. They allege that captains Morrissey Johnson, Ulf Snarby, Jim Gillett and former Newfoundland cabinet mini- ster John Landrigan violated Section 15 of the Newfoundland Seal Fisheries Act by killing harp seal pups on the “front ice” omMarch 12, 1978. The case has now been through the Supreme Court of Newfoungland, and the Appeal ourt of Newfoundland where the court found against Moore i in bothi instances. At issue is whether or not the federal Seal Protection regulations can override the provincial Seal Fisheries Act. The seal protection regulations are Orders in Council, i.e., cabinet decisions, whereas the Seal Fisheries Act is a law passed by the entire ‘Newfoundland legislature. John Lundrigan’s in- volvement in the case stems from his publicity stunt of dressing up as a seal hunter in order to confront late U.S. Congressman Leo Ryan and Congressman Jim Jeffords who accompanied Greenpeace to the ice floes on the opening day of the 1978 seal hunt —.
