22 - Sunday, August 11, 1996 — North Shore News Driver caught drinking and driving again while court-ordered ban on Judge orders jail time and another driving prohibition By Anna Marie D'Angelo News Reporter MICHAEL John Wilkey was pro- hibited from driving for three months whea he was sentenced for drinking and driving in February. wee A little more than a month later, on March 29, Wilkey was at the wheel of his red Honda Civic and drunk. A North Vancouver Mountie pulled Wilkey over in Lower Lonsdale. Wilkey blew 0.23 and 0.24 for alechol in “his blood, Those readings are more than two umes the fegal limit of .08 (80 milligrams of alcohol in one hundred millilitres of blood). The police officer noted that the 26-year- old CN Rail worker almost hit a parked vehicle as he was stopping his car. The officer stated that Wilkey’s face was flushed, his speech was slow and deliberate and there was a “moderate” smell of alcohol com- ing from Wilkey’s direction, said Crown lawyer Trevor Cocktield. Cockfield was speaking during sentencing proceedings in North Vancouver provincial court. Wilkey pleaded guilty on July 10. to impaired ‘driving and driving, while prohibited in connection with the incident. On Wednesday, Judge Bill Rodgers jailed Wilkey 21 days. @-~ Fourteen days of the sentence were for the impaired charge and seven more days were for driving while prohibited. Said Rodgers, “If you come before the courts again (on drinking and driving sentene- ing), you can expect to go to jail in terms of months, not just days,” said Rodgers. Rodgers also prohibited Wilkey from. dri- ving for 18 months. In February, Wilkey was fined $300 and was prohibited from driving for three months in connection with a charge of driving with a blood alcohol greater than .08. Wiitkey's lawyer Dan Sudeyko pointed out that that charge related to an incident that hap- pened in April 1995, 10 months previous to February's sentencing. Concerning the latest impaired charge, Sudeyko said Wilkey and his girlfriend had been drinking beer and wine at the beach, The defence lawyer said Wilkey’s girlfriend was sup- posed to drive, “She was apparently in worse shape than Mr. Wilkey,” said Sudeyko. Sudeyko said his client acknowledges that he has a drinking problem. “He indicates that this is not going to hap- pen again,” said Sudeyko. The Crown lawyer bad asked for 14 days in jail and an 18-month driver's licence suspen- sion, Sudeyko did not disagree with the suggest- ed jail sentence using electronic monitoring. He asked for a 12-month licence suspension as his client had already been unable to drive by court order this year. The judge did not object to the jail sentence being served by electronic monitoring. Wilkey’s second impaired offence was reported to police after he drove his car out of the Chevron gas station near Main Street.
