FARMER HIT BY AFFIRMATIVE ACTION Tha moment his pickup rattied out of the covered bridge, Jed slammed the gas pedal down to the floor, The truck hurtled down the country rcad and came to a screeching stop in front of his farm house. Jed graboed his straw hat, bounded up the stairs and practically stomped through the door. There was Jed's young wife, Anna, preening in an off-the-shoulder taffeta dress. “Darling, | didn't expect you back so quick. Do you like the new dress? “Take it off, we can't afford it” you told me to get something pretty because you wera gatting some more land to farm. Jed was red with frustration. “That was yesterday. | just saw Charlie at the government office. He told me our neighbour's young farm hand, Jamie, applied for the same Crown farming land and he got more points than | did so the government had to give that land to him, Anna suddenly felt her mouth get dry. “That doesn't make sense. You're the most experienced farmer in this part of the country. Heck, at 42, you've been around longer than all these young whippersnappers. Jamie is only 32. Why did he get it?” Jed kicked at the cat. “It's all your fault, you and your friends with your newfangled ideas.” Anna felt her body tense up. “What do you mean?” Clockwise from left: Don Jabour, Cynthia Joseph Dan Sudeyko, Margot Spence Anna locked stunned. "But Jed, just yesterday, Based on Ac Actual “You know, ail that affirmative action nonsense you and your friands have been chattering away, like women shauid get special chances when they compete for jobs Anna looked puzzied. “But what's the connection between women and us not getting an axtra plece of land?" Jed was furious. ‘No difference. That young whippersnapptir got the land because _ he was younger than the rest of us.” Anna was now in a fighting mood. “That's not affirmative action. That's plain discrimination. Jed, sue the 1 n-rninant? Three months later, Jed a: nis wie were siting before the Saskatchewan Human Rights Tribunal. Jed got up. “Members of the tribunal. If it wasn't for the age based points | would have had the same number of points. Farmers face difficult challenges in thelr work, no matter what their age. This ridiculous government policy is pure discrimination egainst oider farmers. That's “tagal.” The representative of the Department of Agricutture aad Food jumped to his feet. “Jed's perfectly right. On the surface the policy is discriminatory. But it's discrimination which is Necessary to promote equality, rural life and agricultural economy, In Saskatchewan, young farmers are a minority group that has suffered greater hardships than older farmers in getting started. Uphold our policy to help young farmers.” Is the age-based point system unjustifiably discriminatory? YOU! BE THE JUDGE. Then look below for “Buying a farm or a house? Van. 986-8600 DECISION. “Sorry Jed, but you're out of luck. The Department of Agriculture is entitled to give extra points to young farmers. The fact is that young farmers have more difficulty establishing themselves, and their numbers are threatened by the hard times. Therefore, the policy is allowed.” Today’s decision is based on the facts of an actual case and the law of Saskatchewan. Claire Bernstain is a lawyer and syndicated columnist.
