But he noted those days are passed and his client, Horst Kern, pleaded guilty in North Vancouver Provincial Court Wed- nesday, to the common assault of a process server who tried to serve him with notice of a foreclosure. Kern, aged 40, of 305-250 West Ist. Street of North Vancouver, was charged Apri! 10. Crown counsel Beauchamp said that a process server went to Kern’s residence that day to serve him, with some documents concerning foreclosure proceedings. He said Kern asked for an explanation of what the documents were and after some discussion refused to take them. Beauchamp said the man then touched Kern with the Ken documents, dropped them at his feet and started walking towards the elevator. At this point, he said, Kern tried to grab the man to stop him from leaving and after a struggle kicked him in the stomach and punched him in the face. Kern's lawyer, Ian Guthrie, said that Kern thought the attempt to deliver the documents was a “subterfuge”. Kern said he became incensed and “extremely ageravated” when the man would not take the documents back. Judge John Layton said the matter obviously called for a small fine and he fined Kern $250. Beauchamp noted that a process server is, in a sense, a peace officer, and Layton said “the court has at least three or four people serving its documents and ... is very jealous to protect its own officers.” City transport priorities outlined North Vancouver City council has adopted a list of priorties for transportation in the area, which will be forwarded to the Greater Vancouver Regional District (GVRD).
