Catherine Barr Contributing Writer A group of North Vancouver residents say they’ve been gagged by a mediation process that failed to solve their problems with 2 late- night fast food outlet. North Vancouver — City councillors voted Monday to take the matter in camera and, if need be, refer the disputing parties to a higher court. At the centre of attention in this dispute is the AAW restau- rant and 24-hour “drive-thru” located at 920 Marine Drive, across from Capilano Mall. The hamburger chain has been fighting a Jong, steady battle with nearby residents who would like to see council amend the business license bylaw. She said she didn’t realize that signing the mediation on behalfof her co-op meant that negotatons had come to an end. “We thought it was part: of the ongoing process,” she said. Resident representative Lori Wall agrees. She has gath- ered the signatures of over 70 nearby neighbours who sup- port the group's fight: to change the bylaw. She told council that, as she under- stands it, no final setdement had been reached. But now, as council ponders its next move, area residents may find themselves legally bound to accept the terms of a negotiated agreement that they sw wall pot solve their prob fem. Cit staff confirmed ta council that che mediation agreement has been signed. As such, it is now a icgal contract between the two par- ties and any further disputes must be settled by a judge. Council, however, must now consider a list. of seven items put forth by the parties as to how they can improve the situation. ‘This includes items like noise issues, garbage and maintenance items as they relate to the area’s zoning. But councillors will not be doing anything until they hear back from staft. And even then, duc to the coniidentiality agreement, the matter will only be discussed behind closed doors. Approximately 15 to 20 per cent of its total business comes from orders placed between midnight and 6 a.m. Both Cooke and regional raanager Rob Fussey said they want to go the extra mile to help the residents. They are satisfied that the results of the mediation are sound and that the process was fair.
