Supreme Court in a case
involving the September
death of a Squamish man
who died after falling rock
struck his vehicle while he
was travelling along the
Squamish highway approx-
imately 25 kilometres north
of Horseshoe Bay.

Robert Norman Holt, 40, suf-
fered fatal head injuries at ap-
proximately 1:40 a.m. Sept. 3
after rock fell from a slope adja-
cent to the highway and crashed
through the windshield of his car
while he was driving near Porteau
Cove.

The suit was filed by West
Vancouver lawyer John Laxton on
behalf of Holt'’s widow, Diana
Holt, and the dead man’s six
children.

The province and Capilano
Highway Services are named as
defendants in the writ.

The plaintiffs are claiming
damages under the Family Com-
pensation Act; their suit alleges
that Holt died as ‘‘a result of the
negligent construction, design,

control, maintenance, or repair of
Highway 99 aad its environs...."°

In a B.C. Supreme Court
judgment earlier this month, a
Burnaby man was awarded more
than $1 million after a boulder
crushed his car in 1982 while trav-
elling the Squamish highway 21.5
kilometres north of Horseshoe
Bay.

The Burnaby man lost a daugh-
ter and was seriously injured in
the accident.
