Open Letter TO THE INSTITUTE OF CHARTERED ACCOUNTANTS OF BRITISH COLUMBIA RE: NOORDIN MADATALI Question: Does a panel of Chartered Accountants have the legal status to rule on matters of rights and privileges granted to Canadians under the Constitution? Further- more, can they restrict citizens from their right to Freedom of Speech? Ina recent disciplirary hearigg into the persona! business matters of Me, Madatali, a panel of three Chartered Accountants, acting on behalf of the Institute, made the following written statement: “..We also ruled that the proceedings did not violate Section 2 (B) of the Canadian Charter of Rights and Freedoms...” Question: Has the Institute of Chartered Accountants overstepped its mandate and, in fact, violated the rights of Mr. Madatali? Should the Institute not be required to review its own staff for unprofessional conduct? The Institute's by-taws require that, within 30 days of its release, the Panel's written decision must be provided simultaneously to both the Institute and to the member being fnvestigated. To further indicate its prejudice against Mr. Madatali. the decision reieased on September 30, 1998 was Inimediately provided to the Institute and its staff, Mr. Madatali received his copy on November 5, 1998 - well after the Institute had purchased large, announcing the discipline of Mr. Madatali.
