Wien making a will, one of the most important things to con- sider is who you want to act as your executor. An executor is the person who carries out the instructions con- tained in a will. Usually, people ask responsible friends, an ac- countant or a trust company, such as Co-operative Trust Com- pany of Canada, to handle their estate. According to reports by a ma- jor Canadian trust company and the Certified General Accoun- tants Association of Ontario, there are four things you should look for in an executor. The person you choose should be willing and available to discharge your wishes properly. As well, he or she should have some financial expertise, since he or she will have to handle your accounting, taxes and sell proper- ties or assets, and could be held personally liable for negligence for any oversights or mistakes. Also, your executor should be fairly impartial to deal with all your beneficiaries. Finally, your executor should live nearby, as most duties must be performed in person. It is also important to choose an alternative executor. If the ex- ecutor you choose dies before you do or for some reason is unable to fulfill that role and you did not choose an alternative, the executor of your executor’s estate has the option of becoming your executor. Clearly, it would be more desirable to name your own alternative. . If you choose to use a Trust Company or accountant, an ex- ecutor’s fee will be taken from your estate to pay for their ser- vices. Fees are approved by pro- vincial surrogate courts and, depending on the complexity of the estate, are usually about two or three per cent of the total value of the estate. An executor is responsible for making funeral arrangements, (unless your family chooses to,) examining your will, making emergency provisions for your family, notifying all beneficiaries and interested parties about the contents of the will, checking the adequacy of insurance on ali assets, seeking legal advice, keep- ing private businesses running, determining the total value of the estate by taking a careful inven- tory of all your possessions, tak- ing any legal action necessary to gain custody of the estate and safety deposit boxes, and for preparing a list of all your debts. Only then can your executor begin to administer or distribute your estate. This process can often take at least six months ever: if your estate is small and your will is uncomplicated. If you have small children, or have indicated that the executor should set up trusts, the executor has a legal responsibility to find competent management for the trusts and review investments regularly. Even when there are no in- structions of this kind, executors are usually required to sell assets, pay off debts and prepare income tax returns before their task is finished.
