A BYLAW keeping owners from parking their cars in front yard.driveways will get a second look ‘| af by North Vancouver City council. The decision was made after residents from the 2500 and 2600 block Western Avenue area petitioned council on behalf of two women who cannot use their driveways because of bylaw restrictions. Neighbors of Federowski and Grace Nolan asked council to relieve the two women of the burden of having to build driveways in their backyard, now that sidewalk im- provements have barricaded them from using front yard driveways they have used for years. Bylaw No. 1967 states in part that off-street parking must be sited at the rear of a house, unless there is a garage at the front of the house. In spite of the bylaw the two women already had driveways with no garages. But when a sidewalk was built on Western Avenue this summer no allowance was made for a curb drop for the driveways, in keeping with the bylaw. Lorna A neighbor living on the same street was allowed a driveway with no garage. But that was only because her property conforms to another section of the bylaw which allows a driveway when there is a minimum clearance of eight feet between the house and the edge of its lot. UNDESIRABLE City Engineer Alan Phillips warned council that if the bylaw was changed some undesirable situations could result. The idea of the bylaw is to keep the residential sections of the City attractive, he had earlier told the News. In a separate but related issue Federowski’s and Nolan's neighbors asked council not to allow a lane to. be built in the 2500-2600 block between Western and Chesterfield Avenues. Houses on the upper half of the block, designated 2600 Chesterfield and 2600 Western, are not separated by a lane. And they don't want to be, spokesman Doug Vincent told council, presenting aldermen with a list of names he said represented 75 per cent of the homeowners who would be affected if a lane were built. City staff have wanted to build a lane there after one resident of the block complained of flooding in her backyard, Phillips told council. The city has dedications of 10 ft. from some of the homes in the block, and not others. But unless everybody agrees the lane can't be built, he said. Vincent said that wasn't the impression he received when he phoned City Hall to discover the law on the matter. The City does have that authority under law, Phillips told council, but if it does that it must pay full market value for the land. Rather, City policy is that expropriation’ is not un- dertaken and the City asks that 10 ft. sections of land be “dedicated” to the City for a nominal fee if residents want a lane, he said. “If some residents of a block dedicate land to the City for a lane and others do not does the City eventually return the dedicated land to its former owners?” asked ‘Alderman Stella Jo Dean. “No,” replied Phillips, “the City keeps it expecting that in the fullness of time the lane will go through.” Council voted to receive the petition and inform residents that the City will not proceed with full opening of the lane.
