Court of Appeal has yet to decide on an appeal of an earlier court ruling that two of seven BC Rail unicns are not bound by a contract settlement reached with the company in late September. {In an Oct. 26 decision, B.C. Supreme Court Mr. Justice Howard Callaghan ruled that the United Transportation Union (UTU) and Local 170 of the Plumbers Pipefitters and Steam- fitters Union could opt out of a Sept. 24 contract settlement. The agreement had been worked out by industrial inquiry commis- sioner Vince Ready between North Vancouver-based BC Rail and the Council of Trade Unions (CTU), which represents seven BC Rail unions and 1,700 employees. Ready’s settlement ended a 25- day strike at BC Rail. CTU members voted 755 to 646 to accept the deal. But shortly after the contract was ratified, the UTU and the plumbers union went to the B.C. Supreme Court and successfully argued that they were not bound by the contract. Lawyers for the unions argued that Ready had no jurisdiction in drafting a settlement. Last week BC Rail appealed the decision, but company spokesman Barrie Wall said no decision has been made on the company’s appeal. The strike, which cost BC Rail an estimated $600,000 in lost rev- enues per day, caused severe eco- nomic hardship to several North Vancouver industries that rely on BC Rail service. The two unions said no job ac- tion has been planned at this time and said they hoped BC Rail would return to the bargaining table.
