At the same time, Charies Haynes, whose son Ross was a student in Sentinel secondary’s French immersion program during the 1995- 96 school year, said the judge’s decision to toss out his lawsuit before it proceeded to trial reveals that teachers now control what parts of the curriculum are taught in B.C. schools. “I think this is unacceptable to most British Columbians,” he said. Haynes alleges that Ross was not taught parts of the Science Humaines curriculum on the Industrial Revolution — equal to approxi- mately 30% of the course load. As a result Haynes launched a small claims court action, asking for the $3,066 it cost him to hire a teacher to tutor Ross and $6,250, or $250 for 25 years, for disability. Filing ani ser- vice fees brought the roral to $9,506. In his March 26 decision, Judge D. Moss said the case against teacher Natatic Lleres, the West Vancouver School Board and board superintendent Doug Player can only be described as educational malpractice, some- thing not recognized as actionable. Inadequate implementation of the educa- tional program cannot constitute a basis for individual liability against a teacher, he said. “The educational program is a framework a Cs dismissed within which the individual teacher must have a broad discretion to teach «cco-ding to his-her percepuion of class dynamics.” static Muss. Haynes said that the pre trial's sole purpose was to derermine if there was a legitimate rea- son to go to tral. Although Moss deterauned there was not gross negline nce, Haynes said he has not presented his case tor gross negligence. Therefore, the allegations should not have been dismissed by Moss, Haynes believes. West Vancouver schoot board chairman Ken Haycock agreed with Moss's decision. He said not all af the course outline for Science Humaines was taught. but added the provincial curriculuni is more detailed and complex than any teacher could deliver in one school year. Teachers, he said, tend co pull parts of the curriculum that meets the needs of the stu- dents, who learn in different ways and at dif- ferent rates. The course outline provided wes based on the teacher’s intentions at the begin- ning of the course. But things happen to slow course work or focus more attention on certain aspects of the course than originally intended. Speaking about Haynes’s case, Haycock said: “You could cover the Industrial Revolution in a one-hour lecture or 27 pradu- ate courses so there is some flexibility provided in course content.” He said there is a broad outline of curricu- lum being taught, but there 3s not “enormous consistency” between schools.
