Last year alone, accident vic- tims made over 48,000 tort claims for injuries and more than 180,000 claims for property dam- age. When settled, the ultimate ‘cost of these claims will exceed $1.1 billion. However, despite the fact that cach of them will be settled by reference to past court decisions on similar losses, few will involve lawyers and fess than one-fil'th’ of 1% will actually be heard in court, This is because, in spite of im- ages conjured up by headlines or certain legal advertisements, most claims are settled successfully through direct negotiations —be- tween the person making the claim and an ICBC adjuster. Although only the courts can make an absolute decision on the settlement of a tort claim, in- surance adjusters may negotiate settlements in the interests of sav- ing time, legal costs and scarce court resources.
