provincial Community Care
Facilities Licencing.

As such, according to the
report, these group homes
are not subject to municipal
zoning or regulations other
than fire or health.

“This effectively means
that any group home ap-
proved and licensed under
the Community Care
Facilities Act does not
require approval of the
council or the residents in
the zoning area,” Mayor
Don Bell's report to council
stated.

CONTROLS NEGATED

This new information
“effectively negates the
present controls council had
in place on most group
homes and those which
might have been con-
templated,” reported Bell,
“as the ultimate control
appears clearly to rest with
the province in these
matters.”

Social planner Jones later
confirmed to the News that
the only control
municipalities will be able to
exercise over these group
homes will be with standard
health and fire laws.

This, she said, had been
confirmed by the District
solicitor and North Van-
couver City.

desire to create a joint group
homes bylaw with the City.

But Jones told the News
she does not think the new
information will mean a
sudden influx of group
homes on the North Shore.

“I think it will mean they
hopefully will be spread
throughout municipalities as
it would presumably be

equally easy to start them i in
any of them.”

And she added: “There is
not the funding to start up
hundreds of them. I am not
aware of any groups who
have funds available and
who are waiting in. the.

As for the Gladstone
home, which was the

catalyst that was responsible
for the provincial ruling
being songht, it is still not
even certain the home will
go ahead.

Much of the furor over the
home arose when neighbors
were .if dy Ministry of
Human Resources staff who
intended opening it that
residents were powerless to
stop the home and it did not
matter whether they ap-
proved of it or not.

Whereas it now appears
that this imformation was
correct, follow-up meetings
between neighbors and
Human Resources have led
to MHR regional manager
Bill Macbeth declaring that
his department will not force
the home on the district.

Macbeth has undertaken
to the News that no decision
will be made over the home
before another meeting with
concerned neighbors, likely
to be held within the next
two weeks.

He said Human Resources
has no desire to locate a
home of “fragile” children in
a hostile environment.

While he considered total
commupbity approval
unlikely, he said his
department will work on
achieving a greater under-
standing and acceptance by
neighbors before going
ahead with the home.
