Supreme Court, Nadia Hisma alleges that her life was turned into “a horrifying nightmare” by the deten- dants. She alleges her reputation is ruined. In February, regional Crown counsel officially decided no: to charge Hama with criminal negligence causing bodily harm of her new two-vear- old daughter Kaya. Kaya has Down's Syndrome. North Vancouver RCMP serious crime officers had recozamended the charge against Hama at the conclusion of a criminal i:westigation. On Sept. 22, 1999, Kava Hania-Werbes fell from her mother’s army at about midspan of the North Vancouver tourist attraction. Kaya fell about 45 metres (150 feet) and survived with a few scratches and bruises. Immediately after the fall, Hama called her estranged husband Kjeld Werbes, a securities lawyer, who in turn called police. At the time Werbes and Hama were ina bitter legal battle involving assets and their children, including a five-year-old son. According to her statement of claim, Hama alleges that the lawsuit defendants caused her to be “used, abused, humi ated in public.” She alleges she was “presumed guilty” and that RCMP and newspaper reporters were “inhuman, unprofessional, low lite.” The deten- dants include the Province, National Post and “all the reporters invelved in reporting about the case.” She is alse suing Capilano Suspension Bridge owners, the Federal Justice Department and the Attorney General Ministry. __.
