The bylaw, which has been given first reading, provides for fines of up to $2,000 a day for those con- clamps down not take place until early 1988 The district is currently in a ree- istration period for all illegal suites which lasts until April 30. Those who register their illegal suites before March | will have a $200 application fee waived. All illegal suites have to be regis- tered before next April 30 in order which every illegal suite in the district, is automatically phased out. Those who do not register their illegal suite before April 30 will not have the option of keeping their il- legal suite for the eight-vear grace period. However, those who have a “lawfully'’ approved second kitchen before the bylaw comes in- to effect will not be subject to the fines, although they will still be considered a non-conforming use. The current bylaw is similar to the one first presented July 13 be- fore Madam Justice Mary Southin, who struck down the district’s ef- forts to legalize inlaw suites. An earlier cour™ruling, however, had upheld the district’s general right to clamp down on illegal suites. Mayor Marilyn Baker describes the present bylaw as a ‘“‘reitera- tion’? of last summer's bylaw. “When Madam Justice Southin quashed that bylaw (regarding in- law suites) there did not seem to be any question ...about addressing this issue (second kitchens) and to proceed to simply reinstate that portion of the bylaw that did not appear to be under challenge."’ The concern about second kitchens comes from the fact that if there is a second kitchen in a home, it's very difficult for building inspectors to tell if an il- | legal suite has been installed. te The bylaw describes a second Hl ey, ip kitchen as a room or portion of a room that contains ‘‘equipment’’ which can be used for meal preparation. The fine of up to $2,000 a day for those convicted of having il- legal second kitchens is at the discretion of the judge. Ald. Mary Segal expressed general support for the intent of the bylaw, but said that it ‘‘cer- tainly can cause some confusion, I think, on the part of individuals who have already had these second kitchens approved and perhaps in future want to carry out some significant structural improve- ments."* Ald.
