She has moved out of their home because he beat her up, but he still phones her or arrives on her doorstep at unpredictable moments. He has threatened her but has not, so far, actually hurt her since she moved oul, but ce Joes seem to be getting more and more angry. I am very concerned about what she should do if he becomes violent. Answer: If your sister has mov- ed out of the matrimonial home and now has a separate home of her own, her husband has no right to be there if she does not want him to be. She has a legal right to insist that he leave, and if he ref- uses, she can call the police and inform them that he is trespassing and ask them to remove him. Likewise, if your sister’s hus- band threatens her life or health, she should call the police. While the police do not like to be in- volved in domestic disputes, in situations where physical violence has occurred, or is likely to occur, they will intervene. It is possible that the presence of a police of- ficer would deliver a clear message that violence is a criminal offence and the situation might resolve itself without police action. It is important that your sister obtain legal information about her situation. Remember that the police, usually called as a last resort, should not be expected to give advice about your rights or to take sides in a dispute. Their role Tune u Specia . When the tape, which will be four to six minutes long, comes to an end, you can ask to hear another one, or re- quest the names of other organizations which may be able to help you. Another way to get legal infor- mation is Lawyer Referral, 687- 3221. You will be put in touch with a lawyer who will give you a 30-minute consultation for $10. After the first half hour you will be charged the going rate, so have your questions prepared before you go so that you don’t waste any time. You could also call the Law Line, operated by the Legal Ser- vices Society, 660-4673. This line is very busy, so be prepared to keep trying.
