While the man’s lawyer charged at last week's council meeting that the opposition was based on racial assump- ons, many Marlborough Heights say his accusation was unfair and untrue. “How they can come up with thar is beyond me,” said Vicky Cowan, who spoke at last week's council meeting against the subdivision of properties in her neighbourhood. “We have a huge diverse culture in North Van and we're doing every- thing we can to protect that.” Steven Ngan, who owns a lot at 150 Sandringham, was in the process of making a Supreme Court application for the removal of a restrictive covenant barring subdivision of lots in the Marlborough Heights area. The covenant was made between a developer and the purchasers of lots in the STRATEGIC residents of 1940s, and did not involve the district. He wanted to subdivide his lot and build nvo heritage-srvde homes. The district's regula- tions would have allowed him te do that. His lawyers were planning to argue there were “flaws” in the old covenant. When he notified neigh- bours he was planning to chal- lenge the covenant, they brought the issue to. district staff.
