By Michael Becker News Reporter Bui Sim Nguyen, 19, of Vancouver, is scheduled to go to trial Nov. 16 to face a charge of heroin possession stemming from an April 5 incident in which four decks of herrin, .2.5 grams of heroin in total, were alleged to have been in the accused’s possession. Nguyen is also scheduled to go.to trial Dec. 9 to face a charge of possession of heroin. for the purpose of trafficking in connection with a May 18 drug seizure. The accused allegedly pos- sessed four decks of heroin with a combined weight of 2.5 grams. And Nguyen is set to go to trial on Jan. 26 to face a charge of posscssion of a narcolic for the purpose of trafficking in connection with an April 21 incident in which the police allegedly contacted Neuyen by cellular telephone and arranged to meet him to buy some ‘‘coke.”” It is alleged that when the accused arrived at the ar- ranged meeting place he was arrested and found to be in possession of nine half-gram decks of cocaine and three quarter-gram decks: of co- caine. Meanwhile, Nguyen faces a trafficking charge in North Vancouver provincial court on July 22 in connection with the June 9 drug Seizure. But in an affidavit filed in B.C. Supreme Court on June - 25 to review bail conditions in connection with the June 9 arrest, Nguyen states that al- though there are outstanding charges against him he ‘has not breached the terms of any court order stemming from the earlier charges against him and that he does not have any criminal convictions for drugs. In the affidavit, Nguyen states that he left: Vietnam in 1983 with his father and stepmother by boat and trav- elled to Hong Kong. The trio lived there in a refugee camp for about five years. In 1988 his family, in- cluding two brothers born in the refugee camp, came to Canada as Canadian govern- ment-sponsored refugees. He became a Canadian cit- izen in 1991, Nguyen decribes himself as ‘“a person of limited means.”’ A WOMAN who claims to have been pushed out of a car near Holidays nightclub in North Vancouver in 1990 has been awarded $145,000 in damages. But B.C. Supreme Court Justice Allan Michael Stewart ruled that Linda Helme, 28, of North Van- couver actually fell out, and was not pushed by a pussenger, in a judgment released July 12 in Vancouver. The incident came just midnight on April 26, 1990. “The passenger door was open when driver Scott Burton of Sur- rey stepped on the gas and in quick succession, Jeanette Ryujin and Helme tumbled from the car,’’ the judge noted. after By Brent Mudry Contributing Writer Ryujin, of North Vancouver, fell first and was not seriously in- jured. Helme fell a few seconds lzter when the car was accelerating. “Burton did not slow or stop the car. He drove to the first available corner and then turned and sped out of sight,”’ the judge noted. The lt-day civil trial featured 25 witnesses and ended June 30 in Vancouver. ‘““A mountain of evidence was placed before me,’’ the judge noted. “Video tapes were surrep- titiously made of Helme by ICBC in her daily life after the acci- dent,’’ Justice Stewart noted. The judge supported Helme’s injury claim, noting she was an ‘ideal employee’’ at Sailor Hagar’s Pub for five years, but was. forced to quit due to intense pain. Helme required two arm opera- tions, and still suffers back pain. The women had called police about an incident earlier that evening at the nightclub. The award includes $40,600 for non-pecuniary damages, $90,000 for foss of past and future in- come, $5,000 for future care, and $10,666 for job-retraining costs.
