EB mailbox [><] AT - Wednesday, June 13, 1984 - North Shore News Gambier bylaws meaningless Dear Editor: In a recent court case, Gambier Island Preservation Society vs Islands Trust, the Honourable Mr. Justice Meredith concurred with the Trust’s argument that they do not have the power to en- force Gambier’s by-laws. Un- fortunately, his Lordship either misapprehended, or failed to accept, our conten- tion that present activities of the mining company are con- trary to the Statutory Objec- tives of the Islands Trust or to Gambier’s zoning by-laws. Since the inception of the Islands Trust in 1974, at the invitation of the government, many man-years have been spent by volunteers develop- ing Community Plans and By-laws, believing that these laws were enforceable by the Trust, under their mandate, to preserve and protect the islands for the benefit of the residents and of the Province generally. Such is not the case. It costs the taxpayers more than $1 milhon a year to sup- port the Trust, a powerless body. Is this not an exhorbi- fant amount of money to spend on a_ bureaucracy which can only give advice. In his decision, his Lord- ship stated that ‘‘The Pro- vince must make the choice.’’ He further pointed out that ‘*There is no doubt that if the project proceeds, it will large- ly destroy the existing en- vironment of Gambier Island as a recreational resource and with it many of the amenities now enjoyed by the residents and visitors to the island.”’ Our case rests: is the Crown land on Gambier to be forever withdrawn from planned public use, either through staking or mining, or is the Crown land to be freed for the use and enjoyment of the public? Will the government make that dicision, and if so, when?
