| MODERN DAY TREATY MAKING |

The. ‘British Columbia Treaty
Commission hosted a televised public
forum on the treaty making process on
February Sth at the Centennial
Theatre. Four people involved in the
treaty making process fielded ques-
tions from a four person panel, the
audience, and those watching the live
telecast on the Knowledge Network.

WHAT IS ON THE TABLE?

The. VP of the United Fishermen
and Workers’ Union, Dennis Brown, led
off by asking BC Treaty Negotiator
Linda Jolson what is actually on the
table for negotiation. She replied that
the role of the commission is to set up
the process, not to decide what is on
the table, but under further questioning
from Mr. Brown, she indicated that
everything is up for negotiation.

Squamish Chief Jne Mathias then
intervened with the statement that
“all land, all resources, all resources
in the sea, all resources underneath
the ground, all resources above the
ground are at the negotiating table.” He
went on to say that there is not enough
money in the world to repay the loss of
language, culture and economic
opportunity.

Chief Mathias later indicated that
only Crown land, not fee simple land
(your house and ot) is on the table and
that this was a concession made by
First Nations people. The Mayor of
Squamish asked him if this meant that
BC Rail right of way was on the table.
He replied that the Provincial
Government has not said what is on
the table but Burrard Inlet and Howe
Sound were “the soup bowl of the
Squamish people.” He then threw back

the question: “What is the Vancouver .

Port Corporation? Are they such a
great corporate God that ownership of
Burrard Inlet does not come to the
table?”

A FLAWED PROCESS?

{t became appavent as the evening

progressed that there is widespread
dissatisfaction with this modern treaty
making process, Questions and state-
ments from interested third parties,
and Chiets who are not taking part in
the negotiations, highlighted frustra-
tions, suspicion and mistrust of the

‘process. Some bands, known as sov-

ereignists, have chosen not to be
involved because they feel that negoti-
ations should be held directly with the
Federal Government, “government to
government”.

te ask about the definition of aboriginal
title, taxation on reserves, and whether
land given in compensation could sub-
sequently be sold back to the Crown.
However, it was clear that these ques-
tions could not be answered by the
panel so | asked the Acting Chief
Commissioner, Barbara — Fisher,
whether the process would permit MPs
to sit in on treaty meetings when the
negotiations deal with treaties in their
Ridings. That way, third party interests '
would have an assurance through their

. MP that their interests were being rep-

resented,

Ms. Fisher indicated that all parties
would have to agree, at which point
Chief Joe Mathias aggressively inter-
rupted by saying, “You are assuming
that you already got our agreement.
You don't have our agreement...a third
party don't have any legal capacity to
sign an agreement”.

Unfortunately, it looks as if | will not
have access to the meetings that will
determine what is “on the table” here in
North Vancouver, and neither will you
have a chance to approve any treaty.
When the Mayor of Squamish asked if
the public could vote on the agree-
ments, Chief Joe Mathias replied that a
public referendum would be the most
dangerous thing that could ever hap-
pen because of the message it would
send to the Indian people if the public
voted down the agreement.
