At approximately 3:30) p.m. one Sunday afternoon, | was alerted by a passerby to a water main located on the north side of the street which slopes upward. To my horror and dis- may, the water main had just Surst, gushing forth a farge volume of water directly onto my property, as well as onto my neighbours’ properties about four or five houses going east along the street. In shock [immediately ran into my house and dialed 9-)-1. The fire department arrived within 10 minutes. Meanwhile, my aging parents, neighbours and the fire crew frantically grabbed some ply- wood sheets which several peo- ple propped up against their dies to divert the flow of water into one of the nearby manholes, Had it not been for a quick-thinking individual who thought of this idea, [ beligve the damage to my prop- erty would have been signifi- cantly worse. The fire depart- ment did not appear to know where the shut off valve was. The = District. of | North Vancouver however did even- tually arrive at around + p.m. and the main valve was shut off. All affected people were without water until p.m. that evening, T had called my house insurance adjusters, = who arrived at my house and sur- veyed the damage to my prop- erty. The damage was worst in the basement, water had seeped through underneath the entrance door, making the carpets sopping wet, and reaching as far as the garden shed. | had to hire emergency clean up/restoration crews who arrived that evening. Ata total cost of approximately $1,200 and three weeks fater, the damage had been cleaned up. I was subsequently advised by my insurance company that I should make a claim against the district for the cost of dam- ages fo my property, since my policy deductible was $500 | did so, by way of a notification letter te the district. Lo and behold, I subse- quendy received a letter from the insurance adjusters for the district advising me that “a nat- ural break was discovered in the main...” and that “the rup- ture of the water main appears to be a random unforeseeable event and the district does not believe it had been negligent.” The — district. ultimately “respectfully denied fiability,” pursuant to the famous case law, cited as Rylands vs. Fletcher. In my opinion, this case is precedented in a very “grey” way, Needless to say, [was aghast at this decision. 1 ask you, property taxpay- ers, ff not the district, who is responsible for these damages? Is it God? If'so, how does God provide his assistance in paying my bilis? I am a single mother of nwo who has diligently paid her annual property taxes. Lam also an honest, hardworking, community-oriented citizen. I am reminded by this of the story of a ain arrested for stealing chickens. Ac his trial, the judge felt that the evidence did not establish clear evidence of guilt and told the man “you are exonerated.” When the accused did not respond the sheriff told him “She means you are free to go — and you get to keep the chickens.” This is surely a fitting paral- tel to the court decision in the Cull case.
