Yes. And no. * ‘The 25-year “minimum” was introduced in 1976 — even for cop- __ killers and the like. It was a trade- off for getting rid of that nasty old noose. The man behind it all was leftist Warren Allmand. He was solicitor general at the time and is now chairraan of the Commons ju-.tice committee. _ Allmand never wanted those . longer’sentences. He believes in the . inborn goodness of the unfortunate crimina]J class, all of whom proba- bly had bad daddies. That's why he announced, also in the 1970s, that punishment was OUT, and rehabilitation IN. You can read the results of that dream every day in the papers. He played a sneaky little trick, too. Killers could apply for early parole after serving only 15 years. At the time, few took any notice of that and even fewer knew about it. He called it the “faint-hope” clause, otherwise known as Section 745. igher Rates “Faint hope” conveyed the impression that a first-degree mur- derer would have almost ne chance of using it. There would be safe- guards. Blah blah and blah. But the Canadian Police Association (CPA) states that up to May of this year there had been 60 early parole hearings of which 43 have been successful. They are made to a judge and jury and only a two-thirds majority favoring parole is needed for the killer to be able to roam the streets again. Over the next 15 years, says the CPA, anather 655 cases will come up for review, including 91 in B.C. Olsen is only one of many vicious killers — like Gregory Fischer and Itis buddy who left a party in Saskatchewan with the stated intention of killing a cop for fun. They removed the licence plates from thcir car to attract police attention and then shot the RCMP guy who stepped them. Their case is up for review and there has already been one hearing. But — unbelievably ~— the judge ruled there has to be another because com- plaints from the victim's family made it difficult for the jury to remain impartial. But what is there to be impartial about? We must be fair, you see. To the killers, that is. The injured parties don't seem to count. . That’s right in line with Allmand’s reasoning. “For many of these murderers it was the only crime they committed in their life,” he has said. “It's crazy to keep them in jail when the prisons are overcrowded.” Here’s another example of Allmand’s wisdom: “To keep them in jail for 25 years is in my view a waste of resources, a waste of a person's life.” 66 We must be fair, you see, To the killers, that is. Allmand’s whining on behalf of trash is all part of the Ottawa sick- ness. Justice Minister Atlan Rock has been feeling a bit of heat recently, for instance. So has our wonderful Immigration Minister. So has the Minister of Finance. That's why they have been making noises about change. But it's all shadow and little substance. Rock has said he has no inten- tion of changing Section 745. So the police are getting up a national petition. The rot goes right through the system. Many murders are no longer murder. They’re manslaugh- ter, as in the case of that guy who carved his wife up. ploughed her ashes into the garden, and got off with five years, serving only three. Meanwhile, those who have made the grade as first-degree murderers learn how to pray the game. The word is: “Show remorse, be a model prisoner and give the tight responses when the shrink comes round.” : It all starts from the bottom up. How do you like this one, reported recently in a Surrey paper? “Young convicts at Willingdon Youth Detention Centre are given money to buy pop and pizzas if they stay out of trouble. If they misbehave, their punishment is to not be paid.” ; Wouid lots of pop and pizzas prevent first-degree murders being committed? Warren Allmand prob- ably thinks so.
