Know your rights

GIVING EVIDENCE in a court of
law is a duty required of all citi-
zens when called upon to do so,
explains the Law Society of B.C.

You cannot -‘‘take the fifth’? as
they do in the United States. That
is, you cannot refuse to testify as a
witness {o a crime for which you
are not the accused on the grounds
it might incriminate you.

If you are the accused, the
Charter of Rights protects you
against self-incrimination in that
you cannot be forced to testify.

However, if. you choose to
testify on your own behalf and
adverse evidence is drawn from
you on cross-examination, that
evidence is admissible against you.
If you do give evidence under
oath, it cannot be later used
against you in another proceeding.

To be a witness you must be
both competent and compellable.

either case, there is no blanket dis-
qualification; rather, each case is
decided on its own merits.

Generally, if the witness unders-
tands the nature of an oath and is
intelligent enough to make the
evidence worthwhile, it will be
admitted.

Small children may be allowed
to give unsworn testimony, and
anyone who has an objection to
the religious component of an oath
may solemnly affirm instead.

Spouses can testify on behalf of
their mate, but cannot be compell-
ed to testify against their mate in a
criminal: proceeding unless the vic-
tim of the crime is under 14.

A spouse may, however, choose
to testify against the other spouse.
For the purposes of the rules of
evidence concerning spouses,
“spouse”? means ‘‘legally mar-
ried.””, A common-law wife or
husband is compellable.
