THE SUPREME Court
hearing into the abor-
tion lawsuit launched by
abortion foe George
Carruthers and Michael
Whelton has been ad-
journed until July 12.

Lawyers representing the
defendants in the civil suit —
the Lions Gate Hospital, its
board of directors and 12
individuals — and the pro-
vincial Attorney-General’s
department presented their
arguments against the suit
Friday.

The lawyer representing
Carruthers and Whelton,
former board members, will
outline their case on July 12,
after which the decision on
whether the case will go to
court will be made.

Carruthers and Whelton
have been attempting to
have the defintion used by
the theraputic abortion
committee of LGH -thrown
out, abortions that have
taken place in the past ruled
unlawful and the hospital
prohibited from, performing
similar abortions in the
future.

Carruthers and Whelton
want Criminal Code provi-
sions under which an abor-
tion can be granted — when
“tthe continuation of the
pregnancy would or would
be likely to endanger life or

health’’— strictly inter-
preted. - ;
Attorney-General Brian

Smith’s involvement in the
case came to light last week
when it was revealed his
department was attempting
to have the suit quashed.

Smith argues that because
the case involves a Criminal
Code definition, the At-
torney-General’s permission
is needed for the suit to pro-
ceed, that Carruthers and
Whelton have no standing to
launch the suit and that a
civil court trial is not the
proper forum for dealing
with Criminal Code matters.

‘“‘We’re disappointed with
the Attorney-General’s posi-
tion,’’ Carruthers said this
week. ‘‘Here is a chance for
the abortion law to be clari-
fied once and for all and it
seems no one wants it clari-
fied.”*
