She maintains that while she was in the paddy wagon an officer kept tapping her on the head witha truncheon to provoke her. When Cunningham was at Lions Gate. Hospital to have his leg ‘stitched, he met his brother, Peter, who was also there for the same reason. The brother had been bitten by two police dogs at the same time. Alistair says that although there was noise outside the building, he considers the party was “really quite tame, for the amountiof people there.” He maintains the charge of unlawful. assembly laid against “his girlfriend is . unfounded since he was with her the entire time and yet he was not charged. Meanwhile, his father, Allan Cunningham, says there are so many irregularities on the part of the police that he wil] be drawing up a dossier with a view to making out a case against the RCMP alleging police brutality. He says he will be ap- pealing for-information from other people in the com- munity who have. cither witnessed of feel they have “WAT home. sundeck, 1 Try low 90's. TOM HUTCHINSON 986-3151, 088-3 “A dog should not be allowed. to undertake an indiscriminate toll of whoever ts there,” he maintains. “I don’t know if it was set on my son deliberately but, more important, it was not called off.” He says of the party scene which confronted the police: “No one is saying they didn’t -have a big - problem or weren't outnumbered: - but they had an advantage.” Inspector Paul Hendricks of North .Van RCMP disputes many of the statements made by the Cunninghams, including the location of the incident. He says the dog master has assured him he stayed in the immediate vicinity of the party and did not encounter Cunningham a block and-a- half away. As for the justification of using. dogs in a party situation, he insists: “We couldn't do without them. We have a limited number of people in an evening and calls coming in all-the time, especially when we have this horrendous party situation.” Hendricks says the Chesterfield address is a repeat trouble spot. Police went there in July in response to neighbors’ complaints and found about 300 people at the party. A person there had told the police it was a party for his birthday and then the same they didn’t bite anyone but these are nasty situations where on occasions some people won’t do what the officer wants them to do. If they were told not to react or made a wrong move con- trary to what the police officer said, it’s likely to happen.” However, he added: “It seems like rather a sub- stantial bite, there’s no doubt about that.” Even so, he said: “I don’t think there was a police overreaction, nor do I feel there was police brutality on the basis of what I know about it and what I was told. These party situations are just a fiasco. There is nothing orderly about them.” As for the decision to send in the men in riot gear, Hendricks explains: “It is not unusual for these party people to become very obnoxious in this situation and they push the police to their point of tolerance where _they have to make a move.” Bottles were = thrown at ‘officers, says Hendricks, adding: “In that type of situation J would endorse helmets being worn. I am not going to wait for a serious injury to authorize it.” Meanwhile, he says he has received no. complaints about police behavior and the only injury he is ex- pecting will be that in court when arrested partygoers appear to face the charges laid against them.
