Home Owner's Alert: District Council Proposes Freeze If you were not watching closely, you probably missed how drastically the District of North Vancouver's proposed text amendment to it's Zoning Bylaw 6934 affects your property rights. On January 21, 1997 the District of North Vancouver held a public hearing on proposed Bylaw 934. The bylaw affects all homes east of Lynn Creek and “freezes” the height of any new construction on the lot to the height of the existing home unless the owner obtains _a development variance permit. The bylaw does not apply to or limit heights on vacant lots. Home owners in Seymour Heights, Blueridge, Deep Cove, ‘Cove Cliff and East Bollarton should be extremely concerned with this restrictive proposal. The Zoning Bylaw of the District of North fancouver presently contains a provision limiting the height of single-family homes to a rang? of 27.5 feet to 30 feet depending on the size and stope of the ict and type of roof. The roposed text amendment would imit all homes to the height of the existing home. If you have a one storey rancher that is aging and were thinking that you would like to rebuild or renovate, you would have to rebuild to the same height or get @ development variance permit. A development variance permit requires the approval of council on an individual basis for any. proposed redevelopment. The council, in deciding on whether to approve such a permit will consider the views of your neighbours _on your proposed new home. The process is slow and unpredictable. It is part of the district's purpose to regulate — the development of land within its boundaries and one would hope that this was done based on solid planning principles. Many of the homes in the district are the height they are because the original owner decided to build it that way.That decision may stand for ail time if this bylaw is passed. One reason expressed by the District for the proposed byiaw is to have 4 policy for height restrictions on the waterfront to prevent monster homes that block views. The oreposed bylaw applies to ail property east of Lynn Creek, except vacant lots, and not just the waterfront. !f you have a monster home, you can replace it. if You have a vacant fot you can build a monster home. If you have a one storey shack, you may or may not be able to build a new two storey home whether or not you are near the water atall. The district in May 1994 adopted a bylaw on these same terms for properties west of Lynn Creek. At the time it was expressed to be an interim measure until specific zoning could be adopted on a__ neighborhood _ basis. Substantial areas west of Lynn Creek still have no neighborhood plans and council intends to proceed wiih those areas first. It would seem that residenis east of Lynn Creek could look forward to being subject to this “interim” zoning for many years. he uncertain and discretiona nature of the development permit process is not desirable.The application —_ of different standards to vacant lots is unsupportable on any plannin principle. A height restriction base on the whims of history is untenable.This is not modern or progressive community planning. If you own a home you need to let Council members know that you do not support Bylaw 6934.
